1. Acceptance of Terms

By accessing or using Diamond In The Ruff (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Diamond In The Ruff is a directory and access platform that helps users locate free public restrooms and purchase time-limited access to private restrooms made available by independent third-party businesses ("Hosts"). We are a facilitator connecting users and Hosts — we do not own, operate, staff, inspect, or control the vast majority of locations listed on the Service.

3. Third-Party Locations — No Control, No Guarantee

Every location listed on the Service, whether public or a private Host location, is owned and operated by a third party. We do not guarantee the accuracy, availability, cleanliness, safety, legality, or condition of any listed location. Listings, ratings, and cleanliness scores are provided for informational convenience only and are not a warranty or certification of any kind.

4. Assumption of Risk

You acknowledge that visiting any physical location — whether discovered through a free listing or accessed through a paid session — is entirely at your own risk. This includes, without limitation, risk of injury, illness, assault, theft, property damage, or loss arising from the condition of a location, the acts or omissions of a Host, another customer, or any other third party. You voluntarily assume all such risk by using the Service.

5. No Warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any location's actual condition will match its listing.

6. Limitation of Liability

To the maximum extent permitted by applicable law, The Diamond Corp, doing business as Diamond In The Ruff, and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, illness, death, loss, or damage of any kind arising out of or related to (a) your use of the Service, (b) your visit to, or use of, any location listed on the Service, or (c) the acts or omissions of any Host or third party, even if we have been advised of the possibility of such damages. Where liability cannot be fully excluded under applicable law, our total liability is limited to the amount you paid us, if any, in the twelve (12) months preceding the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless The Diamond Corp, doing business as Diamond In The Ruff, its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your visit to any listed location, or your violation of these Terms.

8. Host / Partner Locations

Hosts are independent business operators, not employees, agents, or joint venturers of The Diamond Corp, doing business as Diamond In The Ruff. Each Host is solely responsible for the condition, safety, and legal compliance of their own premises, including maintaining any insurance coverage required by law or prudent business practice. Listing a location on the Service does not constitute an endorsement or safety certification.

9. Payments

Paid access sessions are processed securely through our payment provider. Once an access code or QR pass has been issued, payments are generally non-refundable, except where required by applicable law.

Stored Payment Method and Overage Charges. When you complete a paid access purchase, your payment card is securely saved with our payment processor for the limited purpose described below. You authorize us to charge that saved card automatically, without further action or confirmation from you, for any overage amount owed under this section.

Each paid access session includes fifteen (15) minutes of access time. If you remain inside the location beyond that included time, each additional minute (rounded up to the next full minute) is billed at one-tenth (1/10) of the price you paid for the original session. This overage amount is calculated and charged automatically to your saved payment method at the time your session ends (i.e., when your access code or QR pass is scanned to exit). You will not be prompted to re-enter payment information for this charge.

If an overage charge cannot be completed — for example, because the saved card has been declined, has expired, or requires additional authentication — the amount owed remains a valid debt to The Diamond Corp, doing business as Diamond In The Ruff. We reserve the right to attempt to collect any unpaid overage amount through subsequent charge attempts, third-party collection services, or by restricting your future ability to purchase or use the Service, until the amount owed is paid in full.

10. Prohibited Conduct

Sharing or reselling an access code or QR pass issued to you.
Attempting to access a location without a valid, unexpired session.
Submitting false or misleading issue reports.
Using the Service for any unlawful purpose.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, Hosts, or the Service.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of [Your State], without regard to its conflict of laws principles, unless otherwise required by applicable law.

14. Cleaning Staff

Individuals who perform cleaning services for locations on the Service do so through Keep Shining, a separate, standalone application operated by Big Diamond Polishing Co (an affiliate of The Diamond Corp) to manage and complete cleaning assignments. That application and the accounts used to access it are governed by their own separate terms, presented at login. This document governs use of the Diamond In The Ruff customer-facing website and app only, and does not itself define the relationship between Big Diamond Polishing Co and any individual performing cleaning services.
